Occupational  Hearing Loss & Industrial Deafness Compensation Claims

Video Transcript

At levels commonly experienced in daily life noise does not cause damage to hearing.
However exposure to high levels of noise over a long period of time without proper ear protection can give rise to hearing loss.

Loss of hearing is commonly seen in people who have worked for many years in a factory environment beside loud machinery without proper ear protection.  This is known as Industrial Deafness or Noise Induced Hearing Loss (NIHL).

The Noise at Work Regulations 1989 set strict noise levels for employers to adhere to.
If your hearing has deteriorated having worked in a noisy environment you may be entitled to make a personal injury claim for hearing loss.

Types of hearing loss

There are several different types of hearing loss that can occur. These include;

  • Temporary loss of hearing - this  can occur when a person has been subjected to a constant loud noise (usually in the range of 75dB to 80dB) over a period of several concurrent hours.
  • Permanent loss of hearing - can occur if a worker has been exposed to a high level of constant noise in the workplace without adequate protection for several number of years.
  • Tinnitus - affects up to  15% of people at some point in their life and takes the form of a ringing, buzzing, or whistling type of sound in one or both ears. Workers that have to regularly deal with extremely loud tools will be at risk of developing tinnitus over time if effective ear protection is not used.
  • Acoustic trauma - a person or worker maybe subjected to an extremely loud noise or series of loud noises at very close proximity. Without ear protection the acoustic shock from the loud noise can cause irreparable hearing damage such as a perforated eardrum.
