Misprescribed Drugs Compensation Claims
Those looking after you have to make sure that you are not given the wrong medication – yet we often see in the news about medical professionals being overworked and stretched budgets – and when people are put under pressure there is always a possibility of an error taking place.
The NHSLA’s own figures show a decline in compensation claims since 2005/6 http://www.nhsla.com/Publications/, yet careless prescribing of drugs or provision of blood products causes serious injury to many people every year. When this happens, it can be life changing because of the severity of injuries that can result.
There are a number of factors known to contribute to serious drug errors. They include:
- Administering the wrong drug because of misreading the medication
- Providing the wrong blood type to a patient because of carelessness
- Failing to recognise a possible or probable inter-reactions between different drugs
- Delegating specialised treatment to insufficiently trained or overworked staff

Heart attack after bruise to right leg
On 7th April 2007 LS attended A&E following a minor injury sustained to her right calf where she was assessed by an SHO. She was prescribed with analgesia in the form of Morphine, and an antiemetic (anti nausea) drug Metoclopramide. The morphine was administered but instead of Metoclopramide, Metaraminol was administered in error.
She developed central chest pain and blood test showed that she had had a heart attack as a result of being given the wrong drug.
Whilst at the time extremely concerning for LS, the heart attack did not result in any long term damage. She received £6500 in compensation.
Wrong blood type shambles
On 3rd August 2009 KF underwent a blood transfusion. During the course of the transfusion she noticed that the label on the pack of blood carried someone else’s name and date of birth. Fortunately there was no physical injury, but the client developed a form of obsessional-compulsive disorder, general anxiety and depression as well as some elements of PTSD.
Following treatment, she accepted an offer of £5000 in compensation.
