Personal Injury Compensation - Claim Time Limits
The law places a time limit on when people can make a claim for compensation. The time limit for bringing a claim for personal injuries is generally 3 years. This 3 year limit is judged in relation to;
- The date on which the accident or cause of injury occurred; or
- The date of knowledge of an injury; or
- A person’s 18th birthday if they were injured when under the age of 18.
If a claim is not made within this time period you will not generally be able to make a claim, unless there are special circumstances.
2 Year and 3+ Time Limits for Claims
There are however a number of types of claim that have a different limitation period.
A 2 year limit applies to:
- Accidents involving boats and other vessels.
- Accidents involving aircraft.
- Claims under the Criminal Injuries Compensation Scheme.
A limit of more than 3 years applies to:
- Claims under the consumer protection act (10 year limit)
- Claims for breach of contract (6 year limit);
