Arm Injury Compensation Claims Guide
Arm injuries can differ greatly in severity from a simple soft tissue injury to complete amputation. That being said, the value of such injuries will therefore differ greatly depending on the severity.
Compensation for Amputation of Arms
Generally the amputation of both arms will result in an award of up between £158,000 and £197,000 for the pain and suffering.
Where one arm has been lost as a result of the injury, awards will depend on the location of the amputation. As a rule of thumb the more of the limb that is lost the greater the award. Also consideration will be given as to whether or not the use of a prosthetic limb is available and whether the loss is of the dominant arm or not.
However, as a guide the following levels of compensation can be expected:-
• Amputation at the shoulder = at least £90,000
• Amputation above the elbow = £72,000 to £86,000
• Amputation below the elbow = £63,000 to £72,000
Other Arm Injuries
Clearly not all injuries result in amputation. Therefore where injury is other than amputation, again award will vary dependant on severity.
In the most severe of cases where the arm leaves the injured party little better off than if the arm had been lost, then an award of between £63,000 to £86,000 is likely to be considered.
Fractures of the Arm
Fractures of the arm like any other part of the body can cause significant discomfort and future disability. Similarly they can heal very well and leave the injured party with no serious residual effects.
In the case of an award for compensation, the residual effects of the fracture will help determine the level of award.
• Fracture resulting in permanent and substantial disability = £25,750 to £39,000
• Fracture resulting in substantial degree of recovery = £12,600 to £25,750
• Simple fractures resulting in full recovery = £4,350 to £12,600
Soft tissue Injuries
Not all arm injuries result in injuries as severe as fractures or amputation. However, they can also affect someone’s life in a negative way.
Again the level of award will be dependant on the length and severity of the suffering.
However, an award of between £1,000 and £4,350 can be considered.
