What your solicitor does – Transfer of ownership

Sometimes property owners wish to alter ownership – perhaps on marriage, or separation. Frequently there will be a document setting out the arrangement between the parties.

  • Obtaining detailed particulars about your property from you.
  • Obtaining your title deeds and Official Copy Entries from the Land Registry.
  • Preparing the transfer document and perhaps some agreement between parties and forwarding with copy documents for approval by the other party and dealing with their enquiries.
  • Making all necessary Local Authority searches and other enquiries.
  • Dealing with title enquiries and drafting Transfer Deed.
  • Dealing with any mortgage conditions and completing Mortgage Deed.
  • Obtaining signatures to the engrossment of the Transfer Deed.
  • Dealing with Stamp Duty Land Tax.
  • Completing your purchase and dealing with the Transfer Deed and Stamp Duty Land Tax, and lodging application to register your Title to the property. This may take several weeks, but this is after the ownership has changed.
  • Lodging application to register Title to the property.
  • Sending the Title Documents either to the buyer or to your mortgagee.
