Failure to diagnose cancer claim settled for over £400,000 - written by Mark Thomason, Clinical Negligence Team

Mark Thomason and the team at Clear Law were happy to be able to bring a long standing claim on behalf of a wife and family who sadly lost their husband and father due to a delay in diagnosing and treating bowel cancer. Mark has worked with the family for a number of years and was especially happy to be able to bring this longstanding claim to a close for such a positive result.

The history of the claim started some time in 2011 where the deceased began to notice changes in keeping with suspected bowel cancer, namely a change in bowel habit and unexpected weight loss. He attended his GP on a number of occasions from 2013 onwards and it was not until early 2016 that the deceased was finally diagnosed with cancer. He was advised at this stage that sadly the prognosis was not positive.

The deceased is survived by his wife and two young children. They have lost the emotional and financial support of their patriarch and provided instructions to investigate the matter on their behalf.

After quite a contentious and combative legal process the parties were finally able to come together for a beneficial and fruitful round table meeting. This is where representatives from both side engage in productive negotiations to try and bring the claim to a satisfactory conclusion. Following a lengthy meeting a fantastic result was secured.
